Terms of Use

These Terms of Use govern your access to and use of Mi Casa PH and its related services. Please read them carefully.

1. Acceptance of these terms

These Terms of Use (the "Terms") form a binding agreement between you and Mi Casa PH ("Mi Casa", "we", "us", or "our") and govern your access to and use of the Mi Casa website at micasa.ph, together with any related pages, features, tools, and services we provide (collectively, the "Service").

By accessing, browsing, registering for, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree with any part of these Terms, you must not access or use the Service.

We may publish additional guidelines, rules, or policies for specific features of the Service. Where they apply, those guidelines form part of these Terms. If you are using the Service on behalf of a company, agency, or other organisation, you represent that you have authority to bind that organisation to these Terms, and "you" refers to that organisation.

2. About the Service

Mi Casa is an online real-estate marketplace and technology platform for the Philippines. It allows home buyers, renters, homeowners, and real-estate agents and brokers to publish, search, compare, save, and inquire about property listings, including condominiums, houses, townhouses, lots, and commercial spaces, and to discover area-level market information and agent profiles.

Mi Casa provides the platform that connects users with property listings and with the agents, brokers, or owners who publish them. Mi Casa is NOT the seller, lessor, landlord, developer, broker, or agent for any property listed on the Service, and is not a party to any transaction, agreement, lease, or sale that you may enter into with another user, an agent, a broker, or a property owner.

Any contract for the purchase, sale, lease, or rental of a property is concluded solely between the buyer or tenant and the seller, lessor, owner, agent, or broker. Mi Casa does not take part in, supervise, guarantee, or warrant any such transaction, and you deal with other parties at your own discretion and risk. We recommend that you carry out your own due diligence, conduct in-person inspections, and seek independent legal, financial, and professional advice before committing to any property transaction.

3. Eligibility and accounts

You must be at least 18 years old and capable of forming a legally binding contract under the laws of the Philippines to use the Service or to create an account. By using the Service, you represent and warrant that you meet these requirements.

Some features require you to register for an account. When you register, you agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us promptly at hello@micasa.ph if you suspect any unauthorised use of your account or any other breach of security.

You are responsible for all use of your account, whether or not authorised by you, to the extent permitted by law. We may refuse to register, suspend, or close an account at our discretion where we reasonably believe these Terms have been breached, where required for security or legal reasons, or where information provided is false, misleading, or incomplete.

4. Listings, content, and value estimates

Property listings, descriptions, photographs, prices, availability, location details, agent profiles, reviews, and other content made available through the Service are supplied by users, agents, brokers, or property owners ("User Content"), not by Mi Casa. Mi Casa does not create, verify, endorse, or independently confirm User Content and does not control the parties who supply it.

Mi Casa does not guarantee or warrant the accuracy, completeness, currency, legality, quality, availability, or pricing of any listing or other User Content. Listings may be out of date, contain errors, be duplicated, or no longer be available. Prices, terms, fees, taxes, and availability are set by the relevant agent, broker, or owner and may change without notice. You should confirm all material details directly with the listing party before relying on them or taking any action.

Where the Service provides estimated property values, price ranges, market insights, loan or affordability calculations, or similar figures, these are automated, indicative estimates generated from available data and general assumptions. They are NOT formal appraisals, valuations, or financial, tax, or investment advice, are not a guarantee of any actual or achievable price, and should not be relied upon as such. For an authoritative valuation you should consult a licensed appraiser, and for financing you should consult a qualified lender or financial professional.

You retain ownership of the User Content you submit. By submitting User Content to the Service, you grant Mi Casa a non-exclusive, worldwide, royalty-free, sub-licensable licence to host, store, reproduce, display, adapt for formatting, and distribute that content for the purpose of operating, improving, and promoting the Service. You represent and warrant that you have all rights necessary to submit your User Content and to grant this licence, and that your User Content does not infringe the rights of any third party or violate any law. We may remove, edit, or refuse to publish any User Content at our discretion, including content we consider inaccurate, unlawful, or in breach of these Terms, but we are under no obligation to monitor or review it.

5. Acceptable use and prohibited conduct

You agree to use the Service lawfully, responsibly, and only for its intended purposes. You must not use the Service in any way that breaches these Terms, infringes the rights of others, or violates any applicable law or regulation.

Without limiting the foregoing, you must not:

  • Post listings or content that is false, misleading, fraudulent, duplicated, expired, or for properties you are not authorised to advertise;
  • Post content that is unlawful, defamatory, obscene, harassing, discriminatory, threatening, or that infringes intellectual property, privacy, or other rights;
  • Impersonate any person or entity, or misrepresent your identity, licence status, affiliation, or authority to act for a property or party;
  • Use the Service to send spam, unsolicited marketing, chain messages, or to harvest, scrape, or collect other users' personal data or contact details without consent;
  • Attempt to gain unauthorised access to the Service, other accounts, or our systems, or interfere with, disrupt, overload, or circumvent the security or operation of the Service;
  • Introduce viruses, malware, or other harmful code, or use bots, scrapers, or automated means to access the Service except as expressly permitted by us in writing;
  • Reproduce, resell, republish, or commercially exploit the Service or its content without our prior written consent, or use it to build or train a competing product or dataset;
  • Use the Service for any unlawful, deceptive, or harmful purpose, or in any way that could damage, disable, or impair the Service or harm other users.

6. Agent, broker, and seller obligations

If you use the Service to advertise property, generate leads, or offer real-estate services as an agent, broker, developer, or owner, you have additional responsibilities. You must comply with all applicable Philippine real-estate laws and regulations, including the licensing, accreditation, and professional-conduct requirements administered by the Professional Regulation Commission (PRC) and other competent authorities, and with all applicable advertising, consumer-protection, and fair-dealing rules.

You represent and warrant that you are duly authorised to list and market each property you publish, that you hold any licence, accreditation, or authority required to provide your services, and that the information you supply, including any licence or registration details, is true, accurate, and current. Where the Service offers broker or licence verification, that verification is provided as a convenience based on information available to us and does not constitute an endorsement, a guarantee of a party's credentials, or a substitute for your own checks.

You are solely responsible for your listings, your communications with prospective buyers and tenants, the fulfilment of your obligations to them, and your compliance with applicable law. Mi Casa is not your employer, principal, agent, or partner, and nothing in these Terms creates an agency, partnership, joint venture, or employment relationship between you and Mi Casa.

7. Intellectual property

The Service, including its design, layout, text, graphics, logos, trademarks, software, databases, and all other materials we provide (excluding User Content), is owned by or licensed to Mi Casa and is protected by intellectual-property and other laws. The "Mi Casa" name, logo, and brand are our property and may not be used without our prior written permission.

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service for your own lawful, non-commercial use, or, for agents and brokers, to use the Service as permitted for managing your listings and leads. We reserve all rights not expressly granted.

Except as permitted by these Terms or by law, you may not copy, modify, distribute, sell, lease, reverse-engineer, frame, scrape, or create derivative works from any part of the Service or its content without our prior written consent.

8. Third-party links and services

The Service may contain links to, or integrate with, third-party websites, applications, content, or services, including listings from agents and brokers, mapping providers, payment or financing tools, analytics providers, and other resources. These third parties are independent of Mi Casa.

We do not control, endorse, or assume responsibility for any third-party website, service, or content, including its accuracy, availability, terms, privacy practices, or any products or services it offers. Your use of any third-party service is governed by that third party's own terms and policies, and any dealings you have with a third party are solely between you and that third party. We are not liable for any loss or damage arising from your use of, or reliance on, any third-party website, service, or content.

9. Disclaimers

The Service and all content, listings, value estimates, and information made available through it are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, to the fullest extent permitted by applicable law. Mi Casa expressly disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Mi Casa does not warrant that the Service will be uninterrupted, secure, timely, error-free, or free of viruses or other harmful components, or that any defects will be corrected. We do not warrant the accuracy, completeness, reliability, or usefulness of any listing, value estimate, agent profile, review, or other content, and any reliance you place on such material is at your own risk.

For clarity, Mi Casa is a marketplace and technology platform only. It is not the seller, lessor, owner, broker, or agent of any property, is not a party to any property transaction, and gives no warranty regarding any property, any other user, any agent or broker, or the outcome of any inquiry or transaction. You are responsible for your own due diligence and for obtaining independent professional advice.

10. Limitation of liability

To the fullest extent permitted by applicable law, Mi Casa, and its owners, directors, officers, employees, contractors, and partners, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunity, or anticipated savings, arising out of or in connection with your access to or use of, or inability to use, the Service, whether based in contract, tort, negligence, statute, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

Without limiting the above, Mi Casa is not liable for any loss or damage arising from: the accuracy, availability, pricing, or legality of any listing or other content; any act, omission, conduct, or default of any user, agent, broker, owner, or other third party; any transaction, dispute, or dealing between you and another party; any reliance on a value estimate, market insight, or calculator output; or any unauthorised access to or alteration of your content or data.

To the fullest extent permitted by law, the total aggregate liability of Mi Casa arising out of or relating to these Terms or the Service will not exceed the greater of the total amount you paid to Mi Casa, if any, for use of the Service in the twelve months before the event giving rise to the claim, or one thousand Philippine pesos (PHP 1,000). Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable Philippine law, and these limitations apply only to the maximum extent permitted by that law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Mi Casa and its owners, directors, officers, employees, contractors, and partners from and against any and all claims, demands, actions, liabilities, losses, damages, costs, and expenses, including reasonable legal fees, arising out of or in connection with: your use or misuse of the Service; any User Content you submit; your breach of these Terms or of any applicable law; your infringement of the rights of any third party; or any transaction, dispute, or dealing between you and another user, agent, broker, or owner.

We reserve the right, at our own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with us in asserting any available defences. This indemnity obligation survives the termination of these Terms and your use of the Service.

12. Suspension and termination

You may stop using the Service at any time and may request closure of your account by contacting us at hello@micasa.ph. We may suspend, restrict, or terminate your access to the Service or your account, in whole or in part, at any time and with or without notice, where we reasonably believe you have breached these Terms or applicable law, where necessary to protect the Service, other users, or third parties, or where required to do so by law.

On termination, your right to access and use the Service ends, and we may remove or disable access to your listings and other content, subject to any legal retention obligations. Provisions of these Terms that by their nature should survive termination, including those on User Content licences, intellectual property, disclaimers, limitation of liability, indemnification, and governing law, will continue to apply after termination.

13. Governing law and venue

These Terms, and any dispute or claim arising out of or in connection with them, the Service, or their subject matter, are governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to conflict-of-law principles.

You agree that the competent courts of the Republic of the Philippines [venue city — to be added] will have jurisdiction to settle any dispute arising out of or in connection with these Terms or the Service, subject to any mandatory consumer-protection rights you may have under applicable Philippine law. Before resorting to formal proceedings, we encourage you to contact us at hello@micasa.ph so that we can try to resolve the matter informally.

14. Changes to these terms and contact

We may update or modify these Terms from time to time to reflect changes in the Service, our practices, or applicable law. When we do, we will update the "Last updated" date shown above and, where the changes are material, we will take reasonable steps to notify you, such as by posting a notice on the Service or contacting you through the details associated with your account.

Your continued access to or use of the Service after any updated Terms take effect constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service. We encourage you to review these Terms periodically.
